Supreme Court Filing Fees for Probate applications in SA

In order to lodge a Probate application with the Supreme Court of South Australia, you must pay a Filing Fee. This is a fixed cost and the same fee is payable whether you choose to do the application yourself, use a lawyer or engage Probate Consultants.

The Filing Fee is determined according to the gross value of the deceased’s assets. See the Filing Fee tiers below:

Postage

Whilst South Australia has an online Probate application process the following physical documents must be lodged with the Probate Registry:

  • Original Will + Coversheet
  • Certificate of Identity
  • Supplementary affidavits and/or other documents supporting the application

Many of our clients choose to lodge the documents by Post, however, some do so in person by attending the Registry at Sir Samuel Way Building, 241-259 Victoria Square, Adelaide.

If lodging by Post, an A4 sized Registered Envelope is recommended. This ensures the documents, including original Will, are fully tracked and are signed for upon delivery. The cost for this envelope is around $7.

Please Note: The Court does not review a Probate application until it has received the Original Will, Certificate of Identity and other supporting documents (if any).

If you require professional assistance with your Probate application, you will pay the fees set by the service provider. Every service provider charges different fees and the variance between these costs can be substantial.
